Josh is a partner in the firm's Finance Group. His main areas of practice are in financial services regulation and debt finance. He has wide experience advising financial services providers and other public and private sector clients, both on an on-going basis and in complex projects and transactions. His practice includes advice on prudential regulation, consumer/SME finance, payment services, authorisation and compliance issues, license passporting, acquiring transactions, regulatory due diligence, credit servicing, MiFID, personal insolvency, arrears resolution, anti-money laundering and administrative sanctions.

Josh has built a strong reputation in Ireland and internationally in the area of financial services innovation. He advised Government and the Insolvency Service of Ireland on the development and implementation of Ireland's new personal insolvency and bankruptcy regime and engaged extensively with Government departments, the Central Bank of Ireland, Troika, banks and other stakeholders in that process. He developed the legal technology which underpinned one of Ireland's first split mortgages and which earned the Finance Dublin award of Deal of the Year 2014 (Retail Banking).

Josh has a particular interest in how technology impacts upon the delivery of financial services. He is a member of the Regulatory Implementation Group of the FinTech and Payments Association of Ireland which has been established to further the interests of the stakeholders in the Irish FinTech ecosystem, including financial institutions, technology companies and venture capital and private equity investors. He has advised clients on a variety of FinTech issues and projects, including the development of online sales channels for current accounts, savings, loans and deposits, mobile payment services, commercial agency, digital download and other exemptions under the Payment Services Directive, e-money, authorisation perimeter and feasibility studies and engagement with the Central Bank of Ireland.

Josh has experience advising on all regulatory aspects relating to loan portfolio sales, having acted on the bid and sale side of some of the most significant such transactions in recent years. He also advises in relation to the servicing of acquired loans, including servicing contracts and compliance with consumer and SME conduct of business rules. Josh is a member of the Irish Debt Securities Association and contributed to the development of the Association’s response to the introduction of legislation in 2015 to regulate credit servicing in Ireland.

Josh has acted on the authorisation and establishment of a variety of regulated businesses in Ireland, including banks, retail credit firms and credit servicing firms. He recently led the McCann FitzGerald team of lawyers which advised on the development and launch of Ireland’s first new residential mortgage lending platform since the financial crisis.

Josh has worked on a variety of structured debt financing transactions and capital markets transactions, including advising on transfers of receivables and the issue of debt securities, listed and unlisted, secured and unsecured.

Josh has completed two client secondments: one at an international bank and another at the Department of Finance.

Qualifications:

LLB. Law & European Studies (University of Limerick), LLM. European & Comparative Law (University of Limerick), Diploma in Applied Finance Law (Law Society of Ireland). Joshua qualified as a solicitor in 2005.
